ÒWin a Prom DressÓ Contest Rules (the ÒRulesÓ)
Sponsored by Vervegirl.com, Alliance Films Inc. and Youth Culture Inc.
(together Òthe SponsorsÓ)
1. The ÒWin a Prom DressÓ Contest (the ÒContestÓ) runs from April 3, 2008 to April 28, 2008. All entries must be received no later than 11:59 p.m. (EST) on April 28, 2008 after which time the Contest will be closed and no further entries shall be accepted. All entries submitted become the property of the Contest Sponsors and none shall be returned
2. TO ENTER: No purchase or payment necessary. By entering the Contest, you agree to be bound by the Rules. To enter the Contest: visit www.vervegirl.com/promnight, complete the on-line entry form with your full mailing address, first and last names, telephone number and email address (your ÒRegistrant InformationÓ) and submit the entry form in its entirety.
Entries will only be accepted by signing up to Vervegirl.com. All entries must be complete; any missing aforementioned elements will result in a void entry.
Only one (1) qualifying entry per e-mail address or household will be accepted during the Contest Period. In the event it is discovered that any individual attempted to enter the Contest more than once, all of that individualÕs entries will be disqualified from this Contest. Entries generated by a script, macro or other automated means are void. Entries that contain typographical errors, are altered, tampered with, incomplete, inaccurate, irregular in any way, or otherwise not in compliance with these Rules, are also void. Proof of sending an entry is not deemed to be proof of receipt.
Sponsors assume no responsibility for incorrect or inaccurate capture of application information, technical malfunctions, human or technical error, or any combination thereof.
3. [h1] THE GRAND PRIZE: One (1) Grand Prize is available to be won, consisting of one (1) ÒpromÓ dress from The Bay, to be chosen by the Contest winner. The maximum retail value of the dress will be limited to CDN$500 (including applicable taxes), and is subject to in-store stock availability at The Bay stores. No rainchecks or substitutions will be offered.
4. THE DRAW: The random draw will take place on or around April 29, 2008 (the ÒDraw DateÓ) at the head office of Youth Culture Group, located at 245-401 Richmond Street West, Toronto, Ontario. One (1) entry will be randomly selected from among all eligible entries received during the Contest Period. The odds of winning the Contest are dependent on the total number of eligible entries received.
5. The selected entrant will be notified by email or by phone within two (2) days of the Draw Date at the phone number indicated on his/her submitted entry form. If a selected entrant cannot be contacted within two (2) days, the entry will be considered null and void and another entrant will be randomly selected from the remaining eligible entrants.
6. Before a selected entrant may be declared the winner of the Contest, , he or she must,
a. comply with all Contest Rules;
b. answer a time limited, mathematical skill-testing question to be administered by telephone at a pre-arranged, mutually convenient time. If the selected entrant's telephone number is not on file, a Youth Culture representative will request it via email at time the selected entrant is notified that he or she has been selected in the Contest Draw. Selected entrant must provide his/her telephone number within forty-eight (48) hours of such email request, or his/her entry will be considered null and void and another entry will be randomly selected from the remaining eligible entries.
c. within seven (7) days of being contacted, complete and return to the Sponsors a signed Contest eligibility and liability/publicity release (a ÒWaiver of Liability FormÓ) (i) confirming his/her compliance with these Rules , (ii) releasing and indemnifying the Sponsors and their respective parents, subsidiaries and/or related companies, and each of their directors, officers, agents, shareholders, employees, advisors, assignees, licensees, representatives, advertising, media buying and promotional agencies from any and all liability in connection with the Contest and the Grand Prize and, (iii) except where prohibited by law, permitting the Sponsors to use the selected entrantÕs name, address (city and province) photograph, voice and/or image, without compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet, and also waiving all rights (including moral rights) with respect to any and all publicity carried out by the Sponsors. If the selected entrant is under the age of majority, the Waiver of Liability Form must be signed and submitted by his or her parent or legal guardian. Youth Culture Group has the sole authority and discretion to determine whether a Waiver of Liability Form has been properly executed and has the sole authority and discretion to accept or refuse a Waiver of Liability Form that has not been properly executed.
7. ELIGIBILITY: The Contest is open to all residents of Canada between the ages of thirteen to nineteen (13-19), excluding:
a. residents of the province of Quebec,
b. employees, directors, shareholders, officers of the Sponsors, their agents, parent, affiliated or related companies, subsidiaries, divisions and promotional agencies,or persons domiciled with any of the above and/or members of the above persons immediate families. .
Proof of identification must be provided upon request. If the winner of the Contest is under the age of majority, the Grand Prize must be accepted by his or her parent or legal guardian.
8. CONSENT TO USE PERSONAL INFORMATION: By completing the entry form and entering this Contest, your consent is hereby given to the collection, use and distribution of your Registrant Information, by the Sponsors for the purposes of running the Contest (information is stored for approximately one (1) year). Sponsors will not sell or transmit this information to third parties except for the purposes of administering the Contest. Any inquiry concerning the personal information held by the Sponsors should be addressed to the Sponsors at Youth Culture, 401 Richmond Street West, Suite 245, Toronto, ON M5V 1X3.
9. No correspondence will be entered into, except with selected entrants.
10. The Sponsors, their respective parents, subsidiaries, affiliates, franchisees, and each of their directors, officers, employees, shareholders, agents, promotional and media agencies are not in any way responsible nor shall they bear any liability for:
(i) any lost, misplaced, destroyed, delayed, misdirected, ineligible, falsified, incomplete or undelivered entries, nor any entries that fail to comply to the Rules;
(ii) any failure of the www.vervegirl.com or Contest website during the Contest Period, including any problems or technical malfunction of any computer on-line systems, human error, servers, access providers, computer equipment, printing errors, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, delayed or garbled data or transmission, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from downloading any material in the Contest, all of which may affect an entrantÕs ability to participate in the Contest
11. In the event of a dispute regarding who submitted an on-line entry, the entry will be deemed submitted by the authorized holder of the e-mail account. ÒAuthorized account holderÓ is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Selected entrants may be required to provide Sponsors with proof that he/she is the authorized account holder of the e-mail address associated with the selected entry.
12. All entries are subject to verification by Sponsors, who reserve the right to cancel and revoke any entries if they are found to be improper or if the entrant is subsequently found to be ineligible pursuant to the Rules.
13. [h2] [h3] [h4] The Contest is subject to the applicable legislation and regulations of Canada and the relevant province(s) or territory (territories) and is void where prohibited.
14. All decisions of the Contest judges are final and cannot be reviewed or in any way appealed. Grand Prize has no cash surrender value, and is not transferable, refundable, may not be substituted and must be accepted as offered. The Contest Sponsors reserve the right to make reasonable substitutions for all or any portion of the Grand Prize. Sponsors shall not be liable to the confirmed winner of the Grand Prize for any guarantee, warranty, condition or representation, express or implied, relating to the Grand Prize, including without limitation, its quality, condition or fitness for a particular purpose. If the Grand Prize is forfeited, then such forfeited Grand Prize will not be offered to any other entrant and will not be redrawn, unless the Sponsors decide to redraw in their sole discretion.
15. The Contest Sponsors reserve the right to withdraw, amend, terminate or suspend in whole or in part this Contest at any time without prior notice and without liability.
16. Sponsors reserve the right to cancel or suspend any portion of the Contest should a virus, bug or other cause beyond the reasonable control of Sponsors corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of the Contest is a violation of criminal and civil laws, and should such an attempt be made, Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

following definitions apply throughout the Contest
Rules. Where words are defined in the singular, the plural of that word has a
comparable meaning; where words are defined in the plural, the singular form of
that word has a comparable meaning. The possessive form of a word also has a
comparable meaning to that word.
(a) "Entry", or "entry form" means the online entry form
completed and submitted to www.vervegirl.com.(b) ÒEntrantÓ means the person
whose name and applicable personal information are entered on an entry form and
" selected entrant" means an entrant who has been chosen to be a
Contest winner;
(c) " Contest Sponsor" means Youth Culture Inc. and Alliance Films
Inc., their respective publications and the media and promotional partners.,
and each of their respective affiliates, directors, officers, employees and
agents.
