Rules and Regulations

 ÒWin a Duchess Beauty BasketÓ

1.             The Contest runs from April 7th, 2008 to May 7th, 2008 (the Contest Closing Date). Applications submitted will be kept by Youth Culture Group (the Contest Sponsors) for judging purposes until the Contest Closing Date.

2.             No purchase or payment is necessary to enter the Contest.

3.             To enter the Contest, fill out the on-line entry form located on the Contest site at:  www.vervegirl.com (this will include entering your ID and password). If you don't have an ID, you must sign up for one to enter the Contest - directions for obtaining an ID are available at point of entry.

4.             The submission of the on-line entry form constitutes an "Entry".

5.             Limit of one Entry per ID during the Entry Period.

6.             Entries received online shall be deemed to be submitted by the holder of the ID account.

7.             Multiple Entries by the same person or from the same ID will not be entered into the Contest prize draw.

8.             All Entries must be submitted no later than the end of the Entry Period.

9.             Entries will only be accepted on-line and no Entries will be accepted by any other means, including but not limited to regular postal mail.

10.         The selected entrant will be notified by email within seven (7) days of the Draw Date at the email address indicated on their ID account form.  If a selected entrant cannot be contacted within seven (7) days, the Entry is null and void and another entrant will be randomly selected from the remaining eligible Ballots.

11.         Before a selected entrant is declared the winner of the Contest, he or she must answer a time limited, mathematical skill-testing question to be administered by telephone at a mutually convenient time.  If the selected entrant's telephone number is not on file, a Youth Culture representative will request it via email at time the selected entrant is notified that he or she was selected in the Contest draw.

12.         All Application Forms become the property of the Contest Sponsors who assume no responsibility for incorrect or inaccurate capture of application information, technical malfunctions, human or technical error, printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof.

13.         Application materials/data that have been tampered with or altered are void. Contest Sponsors shall not be held responsible for any errors or negligence that may arise or occur in connection with the Competition including any damage to an entrantÕs computer equipment, system, software or any combination thereof, as a result of their participation in this competition.  All decisions of the Contest Sponsors are final in all matters as they relate to this Contest.

14.           THE PRIZE: There will be 3 winners who will receive a Duchess gift basket filled with products – including the one featured in Vervegirl magazineÕs PROM issue. Each basket will be worth $84 retail and will contain:

15.          THE DRAW: On or around May 7th, 2008 (the Draw Date) at the head office of Youth Culture Group, located at 245-401 Richmond Street West, Toronto, Ontario, one Entry will be randomly selected from among all eligible Entries received during the Entry Period. 

16.          Once the winner has confirmed acceptance of the prize, his or her address will be sent to DUCHESS/Strut in order to mail out the baskets.

17.          All shipping charges to be the responsibility of DUCHESS/Strut.

18.          In order to be a selected the winner of the Contest, he or she must, within 10 days of being contacted, complete and return to the Sponsors a contest eligibility and liability/publicity release (a ÒWaiver of Liability FormÓ) confirming compliance with these rules and regulations (the ÒContest RulesÓ), releasing the Sponsors and their respective directors, officers and agents from all liability and, except where prohibited by law, permitting the Sponsors to use the selected entrantÕs name, address (city and province) and image, without compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet, in any publicity carried out by the Sponsors.  If the selected entrant is under the age of majority, the Waiver of Liability Form must be signed and submitted by his or her parent or legal guardian.  Youth Culture Group has the sole authority and discretion to determine whether a Waiver of Liability Form has been properly executed and has the sole authority and discretion to accept or refuse a Waiver of Liability Form that has not been properly executed. 

19.          No correspondence will be entered into, except with selected entrants.

20.          Youth Culture Group, www.fuelpowered.com / www.vervegirl.com / www.b-zone.ca, and (together, the ÒSponsorsÓ), their affiliates, franchisees and each of their directors, officers, employees and agents are not in any way responsible for any lost, misplaced, destroyed, delayed, misdirected or undelivered Entries.

21.          In the event of a dispute regarding who submitted an on-line Entry, the Entry will be deemed submitted by the holder of the e-mail account.

22.          The odds of winning the Contest are dependent on the total number of eligible Entries received. 

23.          Candidates between the ages of thirteen and nineteen, who are residents of Canada (except residents of Quebec), are eligible for selection in the Contest.

24.          CandidateÕs entries are not accepted if they are employees of, or members of the immediate family of, or persons domiciled with an employee of the Contest Sponsors, their agents, parent, affiliated or related companies, subsidiaries, divisions and promotional agencies, are ineligible.  Proof of identification must be provided upon request. If the winner of the Contest is under the age of majority, the Prize must be accepted by his or her parent or legal guardian.

25.          The Contest is subject to the applicable legislation and regulations of Canada and the relevant province(s) or territory (territories) and is void where prohibited.

26.          All decisions of the Contest Judges are final and cannot be reviewed or in any way appealed. Awards to successful Candidates have no cash surrender value. The Contest Sponsors reserve the right to make reasonable substitutions for all or any portion of the Prizes.

27.          The Contest Sponsors reserve the right to withdraw, amend, terminate or suspend in whole or in part this Contest at any time without prior notice and without liability.

28.          By completing the Application Form, consent is given to the collection, use and distribution of the personal information disclosed, by the Competition Sponsors for the purposes of running the Competition (information is stored for approximately 1 year). Competition Sponsors will not sell or transmit this information to third parties except for the purposes of administering the Competition. Any inquiry concerning the personal information held by the Competition Sponsors should be addressed to the Competition Sponsors.

29.          The following definitions apply throughout the Contest Rules. Where words are defined in the singular, the plural of that word has a comparable meaning; where words are defined in the plural, the singular form of that word has a comparable meaning. The possessive form of a word also has a comparable meaning to that word.
(a) "Application Form", or "Application" means the form completed and submitted on the Web site [ www.fuelpowered.com  / www.vervegirl.com / www.b-zone.ca ].;
(b) ÒCandidateÓ means the person whose name and applicable personal information are entered on a Application Form and "Successful Candidate" means a Candidate who has been chosen to be a Contest Winner;
(c) "Competition or Promotion or Contest Sponsor" means Youth Culture Inc., its publications and the media and promotional partners of Youth Culture Inc., and each of their respective affiliates, directors, officers, employees and agents.
