OFFICIAL RULES AND REGULATIONS

           

 

 

NO PURCHASE NECESSARY.  VOID IN QUEBEC AND WHERE PROHIBITED.  OPEN ONLY TO LEGAL RESIDENTS OF CANADA (EXCLUDING QUEBEC) WHO ARE BETWEEN THE AGES OF FOURTEEN (14) AND EIGHTEEN (18) YEARS.

     

1.  TO ENTER the MotorolaÕs Raise Your Voiceª 4 Change contest (the ÒContestÓ) simply visit the web site located at www.raiseyourvoice.ca/4change, click Enter the Contest page. Entrants will be redirected to www.vervegirl.com/4change to complete and submit your entry by following the instructions found on the site. All entries must include your first and last name, address, email address, age, ten digit day time and evening telephone number and creative essay, video log, blog, photo essay containing your positive community change ideas (the ÒInitial Submission(s)Ó). Initial Written submissions are to be no longer than five-hundred (500) words in length with your most cutting-edge ideas for a positive community change. Video submissions are to be no longer than two (2) minutes in length with your most cutting-edge ideas for a positive community change. Photo essay submissions are to be a minimum resolution of 640 x 480 pixels and no larger than 1MB in total image size and be less than five-hundred (500) words with your most cutting-edge ideas for a positive community change. Entries received online shall be deemed to be submitted by the "Authorized Account Holder" of the email address submitted at the time of entry. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Limit of one (1) entry per individual. Illegible entries are ineligible. Contest starts at 10:00 a.m. Eastern Time ("ET") on Monday, April 07 2008 and closes on Monday, June 09, 2008 at 11:59:59 p.m. Eastern Time ("ET") (the ÒContest PeriodÓ). There is one (1) grand prize (the "Grand Prize") to be won from among all the eligible entries received during the Contest Period.

 

2.  SPONSORS:  The contest sponsors are Youth Culture Group and Direct Current Media (DCM) (hereinafter referred to as the ÒContest SponsorsÓ).

 

3.  ELIGIBILITY:  To enter and to be eligible to win, entrant must be a legal resident of Canada (excluding Quebec) and must be between the ages of fourteen (14) and eighteen (18) years of age. Employees and their parents, siblings and children, and persons domiciled with an employee of any of the Contest Sponsors or Motorola Canada Ltd., their agents, parent, affiliated or related companies, subsidiaries, divisions, prize sponsors, and promotional and advertising agencies and administrators, are ineligible to enter. Entrants who are under the age of majority at the date of entry are eligible to enter the Contest and win a prize provided that the parent or legal guardian of the entrant accepts any such prize and the terms and conditions hereof for and on behalf of such entrant.

 

4.  INITIAL Submission Guidelines:  Entries must be the original work of the entrant; may not have won previous awards; may not have been published previously; must not infringe third-party rights, and must be suitable for publication in the sole discretion of Sponsors (i.e., may not be obscene or indecent). 

 

All Initial Submissions written must be no longer than five-hundred (500) words in length. All Initial Submissions visual must be no longer than two (2) minutes in length. And submission format includes most common video file formats (mpeg, Quicktime, .avi) and the site will reformat them to flash files.. Submissions which have been published or publicly exhibited outside of this Contest are not eligible to win. In the event the Submission depicts an individual in a way that the person(s) can be recognized, the entrant must obtain a Consent & Release of Recognizable Individual (ÒConsentÓ), in writing, from the person(s) depicted in the submission. Consent must be in the form as provided by Youth Culture Group, available for download from the Contest web site at www.vervegirl.com/4change. Consent form must be submitted with Submission.  Submissions may be posted on the Contest website. Submissions with recognizable people that are submitted with inadequate Consent forms will not be posted on the Contest website and will not be eligible to win the Grand Prize. Contest Sponsors and Motorola Canada Ltd. assume no responsibility for any claims against infringement of the right of privacy with respect to any submission entered.

 

Submissions will not be returned.  Grand Prize winning entries become the property of the Contest Sponsors and Motorola Canada Ltd., including all intellectual property rights in all entry submissions.  Grand Prize winners irrevocably agree that by submitting entries and upon being elected as a winner, they transfer and assign, all right, title and interest in his/her submission to the Contest Sponsors and Motorola Canada Ltd.  Each winning entrant further agrees to waive all moral rights in the submissions in which each entrant agrees to waive and transfer to the Contest Sponsors and Motorola Canada Ltd. by entering the contest. Contest Sponsors and Motorola Canada Ltd. reserve their unlimited right to display the submission in any form of media, including, without limitation, newspaper, Internet web sites and/or television including but not limited to raiseyourvoice.ca, vervegirl.com and vervegirl.com/4change. Contest Sponsors and Motorola Canada Ltd. reserve their unlimited right to edit or manipulate the submissions for purposes of better editorial display. 

 

Submission of any entry further constitutes the entrantÕs consent to irrevocably assign and transfer to the sponsor any all rights, title and interest in the entry, including, without limitation, all copyrights.  By submitting his/her entry into the Contest, the entrant agrees to comply with all local and international laws that may apply.  Any person featured in submission must sign a release prior to awarding of prize.  Entrant must submit licenses for all third party content in submission. i.e. music or trademarks, prior to awarding a prize.

 

 
6.  Grand Prize:  There is one (1) Grand Prize consisting of a one-thousand-dollar ($1,000) Registered Education Savings Plan (ÒRESPÓ) an one (1) one-thousand-dollar ($1,000) donation to a registered, Canadian government-recognized,
nonprofit (NGO) Canadian charity of the winnerÕs choice.  Grand Prize winner agrees to be profiled via press interviews and media contact and agrees to be profiled within but not limited to the Contest Sponsors and Motorola Canada Ltd. Web sites and promotional materials relating to ÒMotorolaÕs Raise Your Voiceª 4 Change TourÓ and ÒMotorolaÕs Raise Your Voiceª 4 Change ContestÓ at dates to be determined by the Contest Sponsors and Motorola Canada Ltd. In the event the Grand Prize winner is under the age of majority, his or her parent or guardian of the entrant accepts any such prize and the terms and conditions on behalf of such entrant.

 

7.  PRIZE RESTRICTIONS:  Prizes must be accepted as awarded. The Prizes may not be sold, transferred and are not convertible to cash. Contest Sponsors and Motorola Canada Ltd. reserve the right to substitute the Prizes in whole or in part in the event that all or any component of the Prizes are unavailable. Prize winner is solely responsible for all costs not expressly described herein.  

 

8.  JUDGING:  On or after Monday, June 09, 2008 an impartial panel of judges (the "Judges") will review all eligible Initial Submissions. The criteria that will be used by the Judges to determine Grand Prize winner based on the number of entries that best execute, in no particular order: a) Creativity and clarity of your change: How well your idea is described/illustrated; b) Ability to turn your idea for change into action: How realistic is your idea?; c) Sustainability of your change: Is your change something that can be continued into the future?   From Monday, June 30, 2008 to Tuesday, September 31, 2008 the Grand Prize winner and up to ten (10) short-listed Initial Submissions will be posted on www.vervegirl.com/4change and www.raiseyourvoice.com.  Contest Sponsors and Motorola Canada Ltd. assume no responsibility for any claims against infringement of the right of privacy with respect to any creative essay, script or artwork submitted. The odds of winning the Grand Prize will depend on the number of eligible entries received during the Contest Period and conformity with judging criteria. In order to be declared a winner, potential winner must first correctly answer, unaided, a time limited mathematical skill testing question administered by Youth Culture Group.

 

9.  RELEASE OF LIABILITY:  Before being awarded the Grand Prize, potential winner, or if under the age or majority, his or her parent or legal guardian, as applicable, will be required to sign and return within the time stipulated by the Contest Sponsors and Motorola Canada Ltd., a full release and indemnity form stating that he/she has read and understood these official rules and regulations (ÒRulesÓ), grants all consents required, authorizes the Contest Sponsors and Motorola Canada Ltd. to broadcast, publish and disseminate his/her name, city of residence, photograph, likeness, sobriquet and voice, in connection with any promotion or publicity, and/or for general news, entertainment and information purposes at no additional compensation to the potential winner, beyond the awarding of or participation in the Prize, accepts the Prize as offered and releases the Contest Sponsors and Motorola Canada Ltd. from any and all liability of any kind arising out of the potential winnerÕs, participation in this Contest and receipt and use of the Grand Prize. In the event that the potential winner and/or traveling companion, as applicable, do not comply with all the provisions as contemplated in these Rules, Contest Sponsors and Motorola Canada Ltd. shall have the right to disqualify potential winner and draw an alternate potential winner and the Contest Sponsors and Motorola Canada Ltd. shall be fully and completely released and discharged from any liability or responsibility in this regard. The provisions and procedures referred to above relating to selection and notification of a potential winner and/or traveling companion, if applicable, shall be applied, with the necessary amendments, until a qualified winner has been duly selected.

 

10.  ACCEPTANCE OF RULES:  By entering this Contest the entrants and participants automatically agree to accept and abide by these Rules. All decisions of the Contest Sponsors and Motorola Canada Ltd. with respect to any aspect of this Contest, including without limitation the eligibility of entries, are final and binding on all entrants in all matters as they relate to this Contest. Entries that are not original compositions by the entrant, illegal, defamatory, obscene, or entries that discriminate based on grounds set out in Human Rights codes or other applicable legislation will not be eligible.

 

11.  MISCELLANEOUS:  Contest Sponsors and Motorola Canada Ltd. assume no responsibility for garbled, lost, late, delayed, destroyed or misdirected mail, voice messages, e-mail or any computer errors or malfunctions. No correspondence will be entered into except with entrants requesting Rules by mail or requesting names of prize winner (for which a self-addressed, postage paid envelope must be included). Contest Sponsors and Motorola Canada Ltd. do not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials-data that have been tampered with or altered are void. If for any reason, in the opinion of the Contest Sponsors and Motorola Canada Ltd., in their sole discretion, the Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond their control, Contest Sponsors and Motorola Canada Ltd. reserve their right to cancel, terminate, modify, amend, extend or suspend the Contest including canceling any method of entry, and select a winner from previously received eligible entries. Contest Sponsors and Motorola Canada Ltd. reserve their right to modify the Rules without materially affecting the terms and conditions hereof. The Contest Sponsors and Motorola Canada Ltd. reserve their right in their sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Rules or otherwise in a disruptive manner. Contest Sponsors and Motorola Canada Ltd. in their sole discretion, further reserve their right to terminate the on-line portion, as applicable, of the Contest and conduct the judging from all on-line entries and all other entries (as applicable) previously received during the Contest Period. Any attempts to deliberately damage the Contest web site or web sites or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made the Contest Sponsors and Motorola Canada Ltd. reserve their right to seek remedies and damages to the fullest extent of the law.  Contest Sponsors and Motorola Canada Ltd. shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to an entrantÕs computer equipment, system, software or any combination thereof, as a result of their participation in this Contest or from downloading any material from the Contest web site or web sites, where applicable.

 

12.  LAWS AND PRIVACY POLICY:  Contest is subject to all applicable federal, provincial and municipal laws and regulations. Personal information collected from entrants will be used by Contest Sponsors and Motorola Canada Ltd. for the purpose of administering this Contest and, if consent is given at the time of entry, to provide the entrants with marketing information relating to new and existing products and upcoming promotions of the Contest Sponsors and Motorola Canada Ltd. by mail or e-mail. Entrants are able to opt in with respect to receiving such marketing information online. Contest Sponsors and Motorola Canada Ltd. will not sell, share or otherwise disclose personal information of entrants with third parties, other than to third parties engaged by them to fulfil the above purposes or as permitted or required by law. By entering the Contest, entrants consent to the manner of collection, use and disclosure of personal information as set out in Youth Culture GroupÕs Privacy policy at www.vervegirl.com, Direct Current MediaÕs Privacy policy at www.4real.com/privacy.asp and Motorola Canada Ltd.'s Privacy policy at motorola.com/privacy.
